Last week I spoke about PROFESSIONAL TAX EXPERTS PROFILING and how TAXtalk is out to profile the specialists and experts in the tax industry so that we all know who these experts are.

In an article posted in the TAXtalk newsletter last week, Sanchia Temkin, professional services editor wrote an article titled: Tax judges "need to be experts", this article touches on the issue of the need for specialised tax attorneys and experts to act as judges. SA's tax court judges have been accused of not always having sufficient knowledge or experience to hear the cases that come before them.
Sanchia reports that SA has specialised tax courts, but the judges are drawn from other courts and many of them have no specialist training in tax. Prof Bob Williams, a tax expert at the University of Kwazulu-Natal, says that tax court judges do need to be specialists and experts in tax law.

The changes that are taking place in tax legislation are at such a rapid pace, they are unlike those in any other area of law. Emil Brincker commented in this article that a judge should have some grounding in tax law and that it requires someone who deals with tax law and business on a daily basis.

Sanchia writes that specialisation in any field is always more desirable when representing the business community keeping in mind that tax is a complicated area of law.
